My daughter%26#039;s car broke down and her boyfriend (who has now left) and his father was supposed to tow her car somewhere for an estimate to repair it (it%26#039;s a cadillac) and they towed her to a Toyota Dealership and she was talked into signing contracts to purchase it (brand new 2008 car) - to come back with a check to pay it in full and a second contract to finance it, and they let her leave with the car keeping her cadillac (which I, her mom have the title too) and she doesn%26#039;t have a job, so they couldn%26#039;t possibly get her financed and they did not check to see if she had the funds to pay for it in full. The boyfriend talked her into loaning the car out a couple days after she got it and the people got into a wreck and left the schene of the accident. The other driver was at fault, but has no insurance and my daughter%26#039;s auto insurance won%26#039;t pay to fix the car (over $10,000 in damages/maybe totalled) because she was not driving the car when it was wrecked. ANY ADVICE?

Thorn is right as far as if the car still had dealer plates, then they also have insurance. She should have signed a notice that states if she were in an accident, her insurance would cover it, however if not, the dealership would typically with $1,000 deductibles.



The problem is the driver was not insured. If the loan is final and she has taken delivery, then she will have to deal with it. Otherwise, it%26#039;s still the dealerships car and they will have to have the vehicle repaired, but since she signed the agreement, she will probably be liable for the deductible. You might want to see how the dealership handles this and if you need, consult an attorney.



So basically, if she is not approved for the loan, then the car still belongs to the dealership and it%26#039;s the dealerships responsibility and is the risk they take in doing a spot delivery.

One thing that is sure that will happen, the credit is ruined for all of you. This are a couple of cases altogether. If she never took the car from the dealer, it could be possible to reverse the purchase. You have a X amount of days to return the car. But she took it and not only that, made the very bad decision to let someone borrow it and wrecked the vehicle.

Sounds like she has a problem with saying no. Did they hold a gun to her head to sign the papers? She obviously had something to show as income or they would not have let her take the car. the main problem here is that more than likely the vehicle is totaled. For most insurances if the damage exceeds 35% to 45% they consider it a total loss. The problem with that is that the insurance is right,, they dont have to pay for it, because the insured person was not in the car at the time of the accident.

If you are established I would simply recommend that you consult your accountant.



If your are not established I would recommend the following:



1) By the car in your name: Works out better if the company fails. You will not need business insurance, $$$$$$$!



2) Use standard insurance unless you are hauling people. Do what ever you have to do NOT to carry business clients. Have them meet you somewhere. If you are going to carry clients then you need business insurance. Other then that if you had an accident then that%26#039;s all you have is an accident. But if you have clients then you better have business insurance. I do not carry clients and I do not carry business insurance. Which maybe a good reason not to rap your vehicle.



3) Basically the IRS either allows your to claim all your receipts...gas, maintenance, insurance, etc...or you can just take the mileage write off. I would recommend the mileage write off. All you do is keep track of your mileage and then at the end of the year you just give that to your tax preparer and your done. Remember that the IRS does not allow you to write off personal miles or miles to the office...everyone has to get to work.



4) You need to consider whether to buy or lease. If you lease you can write off the amount of the lease...opposed to a % of the purchase price and I think that is only for 3 years (worth of depreciation.) Be careful if you lease. Leasing fits my business needs great but that can be a monkey on your back if leasing is not good for you. In reference to miles, get at lest 15,000 per year and if you think you are going to need more then buy them up front. If you buy them at the beginning of the lease they are a fraction of the price as opposed to buying them at turn in.

There are irs requirements to take your car off your business instead of just expenses or gas mileage. If you decide to deduct it, it must be in the company%26#039;s name. some realtors I know do it and they have to keep those magnetic signs on their cars. It is good advertisement and good deductions. Get good advice before leap.

Once the car is off the lot the dealership will have nothing to do with it, beyond mechanical services and trade-in/return. From that point on any problems with financing are handled by the lender, if the dealership is the financier its not the same department that sold you the car, if anything is done the lender is who will do it. Now if your check bounces, don%26#039;t be surprised to wake up one morning with someone representing state and federal agencies knocking at your door. Oh, and to the person above, post-dated checks are not illegal, it depends on the State and situation in which the check is written, private persons and some lending business (with licenses) can accept post-dated checks.

They can bring criminal charges against you if the check bounces...... as it is illegal to write a bad check. No dealer should sell a car without a title. I work for a large dealer in sales. If the title has not been signed over, that means the transaction is not complete. Go drop the car off on his doorstep and tell him to go F himself.



Seriously, I would call your local police department, and ask them to go with you to the dealership so there is no hassle, and tell the dealership you want all paperwork regarding your deal, shredded and voided. You cannot legally sell a vehicle without a title. If you have the police with you, there should be no dispute whatsoever.



The dealer is playing some funny game, and it all sounds very fishy to me, as I have been selling cars for a long time.

The police tow my car without my authorization and the tow company sends me the tow bill for $300. Im responsible for the bill or the tow company will put a lien on my license. Instead, I opted for basic PIP coverage on my car since it was a 1998 honda civic with 80k miles only worth 5k. Think of it this way: if you continued to pay the $159 a month, you wouldn%26#039;t have to pay 5K now....that%26#039;s why insurance is a good idea. Sometimes you have to spend a little to save a lot. Those who are wise with money always have a little saved for when a rainy day happens. Legally there is not much you can do but go back to the seller...if you can find them...You should always have an HPI check done on any car purchase.

I don%26#039;t know about Scotland, but in Canada, if that happens, than %26quot;you%26quot; the purchaser is now responsible for the debt. Look at it this way....a loan was taken out, with the car used as credit. If the original borrower stopped making payments, then the bank will have no recourse but take the car back...it doesn%26#039;t matter that the car is now yours.

I%26#039;m guessing that it was a used car ... no new car dealer would let you have a new vehicle without a clear plan for financing before you walked out the door. Used car dealers are much less stringent with their %26#039;money%26#039; requirements and will let you take a car with little or no money down, with the understanding that they%26#039;ll be able to find financing for you, since you evidently didn%26#039;t come to them pre-approved with your own financing. You were doing each other a favor ... you wanted to buy one of their cars and they were trying to get you financing! I%26#039;d also guess that your credit record isn%26#039;t the cleanest it could be, because after the banks and usual lenders, there are plenty of cut-throat lenders who will lend money for nearly anything being financed.



If they tried to get you financing for 3 weeks and couldn%26#039;t find a lender, they have the absolute right to demand the car. They also have the right to take possession of it anywhere, anytime after adequate warning of their intent to take it back. Sounds like you chose not to return it. The law is on their side ... I wouldn%26#039;t recommend trying to sue because you can%26#039;t get financing for the car. That is clearly your problem, not theirs. I think that if you read over the binder for the sale, you%26#039;ll see everything you mentioned, listed in detail, somewhere in the contract. Good luck!

No, you probably cant sue, I have been in auto finance for 10 years, and if you kept the car, then they could have done nothing about it,



sometimes dealers take a risk and %26quot;spot%26quot; a car, which means they deliver in faith that they can get a bank to finance, However if you signed a contract that had a payment schedule, and interest amount on it, and an application for registration and title transfer and the dealer failed to find financing, you could have kept the car, and the dealer would have to %26quot;hold%26quot; the contract and seek payments from you.



The bad part that dealers dont usually understand ( usually newer dealers) is that If you spot a car to someone, and cant get them financed. the dealer owns the car, and the contract.... even worse for the dealer if they do this and the customer fails to pay them.. they cannot reposses the car ( because they arent a legal lending institution ) %26quot;a bank%26quot; and have no recourse.



It is common for dealers to scare you into bringing the car back,
