You are officially stupid. It%26#039;s a post dated check (not a predated check) and it%26#039;s illegal to write a post dated check. If you notice, it%26#039;s write, not wright.



Why in the world would you buy a car if you didn%26#039;t have the funds to cover your down payment check? Answer: You are stupid. And no, they cannot repossess the car and they have transferred their security interest to the lien holder (the finance company) Good luck dip stick.

They will probably go after you for the bank fees that they are going to incur if and when the check bounces. . .and it%26#039;s going to LOOK HORRIBLE on your credit rating. . .they might not re-deposit the check either. . . .they might say -- we need a new check . . . .and they can and will do anything they want. . . I think if they felt it necessary to take the car back they will!!!!!! If you have little or no financial history with the financing company -- they don%26#039;t %26quot;know%26quot; you and you are going to look really sketchy. . . .

Once the car is off the lot the dealership will have nothing to do with it, beyond mechanical services and trade-in/return. From that point on any problems with financing are handled by the lender, if the dealership is the financier its not the same department that sold you the car, if anything is done the lender is who will do it. Now if your check bounces, don%26#039;t be surprised to wake up one morning with someone representing state and federal agencies knocking at your door. Oh, and to the person above, post-dated checks are not illegal, it depends on the State and situation in which the check is written, private persons and some lending business (with licenses) can accept post-dated checks.

They can bring criminal charges against you if the check bounces...... as it is illegal to write a bad check. I believe they can also attach a lien on the vehicle which would mean you wouldn%26#039;t be able to sell it or trade it until the dealership is paid in full. Not something you want to do..... make sure the funds are there for the check to clear!!
