I need some help. The finance company says they are going to repo my car. I need to know whether the repo agent can come on my property and break in my garage to get the car that I am delinquent on? California Law? I appreciate any help. I%26#039;m not sure how long it will take to repo it and I need to buy some time to come up with the cash.

it is UNIVERSALLY held that a repo man can not %26quot;breach the peace%26quot; when repo-ing. this means that anything he does that breaks the law is a no no. so if your car is locked up in your personal garage, he can not break into it and take the car. (i guess he still can but its against the rules for repo and the sale of the car would not be valid by your creditor) so as long as you keep that car locked up - he cant do anything legally. but if you drive it anywhere and leave it in public he could take it then really easily. look in article 9 of the uniform commercial code - do a search and i think cornell has a website were you can search the code and find the exact wording of %26quot;breach the peace%26quot;

If they can find it, they can take it from any property other than an impound yard, a law-enforcement agency or a Marshall%26#039;s yard.

they cant break in on your property,but they can bring the law with them,and make you let them have it if they catch you home,it sounds like you have run out of time on this one,i have known them to go to extremes on getting some back,it all depends on how much you owe on it,and what year it is,some cars they will get any way they can,,just be careful and don%26#039;t break any more laws then you have to,they can get you also, if they think your breaking the law , good luck,i hope this help,s.

The will come -- and they will bring a Sherriff and a pair of bolt cutters. All perfectly legal. Just do yourself a big favor and surrender the car. Your only hope is to come up with enough cash to stop the repo -- IF they agree to that. Usually once the repo has been issued it%26#039;s a done deal.

They can come onto your property, but can not break into or enter your house... What we usually do is watch you and find out where you work ... if you go to church... where your family lives( Christmas and holidays are great, to snatch a car from a relatives house.) We can get all your info from your Social security # and drivers license... Best to clear it up.. because your on the wrong route to solving the problem.. take the car and hide it in a friends garage where it cannot be seen---------------- then when ask about the car by the finance company tell them you will surrender the vehicle in one month (( that%26#039;s 30 days))) or you will pay up and get current .... if you cannot do this and be honest about 30 days ...........you must surrender the vehicle .... that was your signed agreement with the finance co. when they paid the dealer and you started driving the automobile .. .. otherwise come up with the cash and pay off the ride....
