How can I get a new car since my new 2008 Corolla was moderately damaged in rear and deemed repairab

The car was three weeks old. Other driver at fault, ticket issued. My vehicle is financed and was not totaled. My insurance co. says that I have to take car back after repairs. My car will have a much lesser value than what it was pre-accident- making my car payments feel worthless. Is there any good way I can get a new car and feel great about the car note being equal to the worth of the car? I have read about diminished value claims and trading the %26quot;rebuilt wreck%26quot; in for a new car. Are these options worth a try without me having to come out-of-pocket for any additional costs?

Unfortunately no. Especially since you are dealing with your own insurance company and not the other drivers. Your vehicle is worth less when trading into a dealership as it will show up on Carfax as wrecked but our insurance policies do not cover for that.

You could try to hire an attorney to sue for the loss of value but you would be rolling the dice on the outcome and could have to pay the other persons attorney bill. 8K is not enough damage for a total loss. You needed it to be over 60% of the value of the car and with the car being 3 weeks old they will use the MSRP as the value. I feel your pain and wish I could have told you what you wanted to hear but it is not factual

The only time the value is truly diminished is when it is %26quot;totaled%26quot;. You are %26quot;sour grapes%26quot; over the fact that someone hit your new car. That is understandable, but as you said it has moderate damage..not severe. It should be able to be properly repaired and driven as it was before the wreck. Don%26#039;t sweat it, a 3 week old car will be fitted with all new parts, be repaired with attention to every detail, and be the %26quot;same%26quot; car that it was 10 minutes before the hit.



When you pick up the car you have the right to have the vehicle inspected by an independent party to ensure all repairs have been done correctly, they will also tell you if the car has been de- valued through the accident.

Also check the terms (those long ugly documents) of your insurance policy. If the policy has specific exclusions for diminished value (which is more and more common) you have no options. If it doesn%26#039;t you do have the legal approaches others have mentioned - but suing an insurance company is kind of like suing the government. They have all the time in the world and as many lawyers as they want.
