I have the vehicle and want to return it. The dealer is saying I own it. and they are going to finance me alone to same terms. They have my old car as a trade.

Well, if you signed a contract and that contract does not note %26quot;contingent on wifes approval%26quot; or if you do not have paperwork signed by you and the dealer than you may be stuck.

If the contract states the above condition or if you have a written agreement between you and the dealer saying so than you can get out of the deal.

If you have not signed a contract yet than there is no deal.

In short if you got this in writing then you can get out of the deal but if you did not get it in writing and you signed a contract then you may be stuck and should consult an attorney for further guidence.

A contract stands alone. (You can not have limitations or exclusions on a contract that do not appear on the document.)

If it does not say ON THE CONTRACT that it is %26quot;contingent upon your wife%26#039;s approval and signature%26quot; then you bought yourself a car and you can not do anything about it. The same with the loan as that is a separate contract from the sales contract.

If it DOES say that on the contract, you only need to point it out to them and tell them they do not have her signature as required by the contract so the sale is null and void.
